A special relationship comes into being between a physician and a patient (even when the former is a dependent of a healthcare facility); and here can occur situations and procedures in which medical activity may cause damages to the latter. There is also a question of trust, even though the doctor is not in charge to "fulfil the contractual obligations he/she has entered into with the patients". This trust is justified by the doctor's professional qualities, but this is not, in and of itself, sufficient to compel the recognition of the validity of a patient's claim that he/she has been the victim of medical malpractice and the doctor has violated his/ her obligation to protect.[Abstract appeared in the Journal]

Responsabilità extracontrattuale del medico di una struttura sanitaria pubblica o privata salvo che abbia agito per l'adempimento di un'obbligazione contrattuale assunta col paziente.
