The reasons given to justify the abolition of the crime of abuse of office do not seem to withstand to a critical evaluation: in particular, the exceeding number of entries in the register of suspects is not due to an imprecise formulation of the incriminating norm, given that this is already precisely (indeed, excessively) circumscribed. Furthermore, other incriminating norms would remain applicable to public officials' abuses, even for actions previously undertaken, and this would not allow the so- called "defensive bureaucracy" to be overcame. Finally, since the total repeal of the art. 323 Cp would also result in a message, highly negative in ethical terms, of renunciation of judicial control over the legality of the exercise of public functions, the "abolitio criminis" appears neither justified nor acceptable.[Abstract appeared in the Journal]
Sommario: 1. La situazione attuale. - 2. Le ragioni addotte per giustificare l'abolizione dell'abuso di ufficio. - 3. Valutazione degli argomenti. - 3.1. Poche condanne e squilibrio fra numero di queste e numero delle iscrizioni nel registro degli indagati. - 3.2. Il sistema dei delitti contro la P.A. è adeguato alla repressione dei fatti meritevoli di pena. - 3.3. Oltre alla fattispecie di reato è previsto un insieme organico di rimedi preventivi e repressivi, di natura disciplinare, contabile ed erariale. - 3.4. L'abolizione del delitto consentirebbe di evitare inutili sovraccarichi per l'apparato giudiziario e ricadute negative per gli indagati, a fronte di fatti che non rientrano in alcun illecito penale. - 4. Le possibili conseguenze dell'abrogazione dell'art. 323. - 5. Conclusioni.
