The paper deals with the procedure of liquidation of the inheritance and, in particular, with the formation of the "state of graduation", specifically addressing two issues. The first concerns the criteria according to which, in the presence of several legacies of species, one should be sold rather than the other in the event of insufficiency of the inheritance assets to satisfy all the creditors; in this regard, in the absence of a specific rule, it is believed that the criteria of proportional reduction indicated by the code in Article 558, paragraph 1, of the Civil Code can be applied by analogy. The second relates to the criteria of graduation that must be followed where there is a legacy in substitution of legitimacy among the legatees. In this regard, on the basis of a systematic analysis of the discipline of legacies in substitution of legitimacy, it is concluded that where the assets of the inheritance are insufficient to pay the creditors, in the concurrence among several legatees of species, the legatees in substitution of legitimacy should be preferred to the ordinary legatees of species in the distribution of any residue; if, on the other hand, there is no insufficient asset to pay the creditors, in the state of graduation the creditors in first place then the legatee, with preference, even in that case, to the legatees in substitution of legitimacy, who shall be preferred to the other legatees.[Abstract appeared in the Journal]
