The article analyzed the main legal innovations of the decree-law n. 2 of 2023 concerning the Ilva steel plant in Taranto. The decree-law n. 2 of 2023 designated Ilva as a "national strategic facility" and introduced new legislative measures to ensure its continuous operation. To provide a definition of the concept of a "national strategic facility", it was necessary to contextualize the provisions of the decree-law within the broader Ilva's issues. Subsequently, the decree-law n. 2 of 2023 allowed for the completion of the acquisition of the plant by the State through Invitalia, an enterprise under the control of the Ministry of Economy and Finance. The study examined the legal and constitutional implications of the state's involvement in managing Ilva Taranto, especially in light of the new formulation of Article 41 of the Constitution. Lastly, the decree-law n. 2 of 2023 introduced a new penal shield, aiming to protect individuals involved in ensuring the continuous operation of the strategic facility from criminal proceedings, provided that they comply with the provisions of the "measure authorizing the continuation of the activity". The implications and constitutional concerns related to the penal shield were examined.[Abstract appeared in the Journal]
