According to the 2000 constitutional revision, effectiveness of the vote of Italians abroad must be ensured while respecting the regularity of the electoral process and the requirements of equality, freedom, personality and secrecy of the vote. However, these principles could be circumvented in practice, as shown by investigations into postal voting and fraudulent conduct to acquire Italian citizenship. In order to prevent unlawful conduct from undermining the legitimacy of the elected Prime Minister, corrective legislation is needed, in line with the case law of the Constitutional Court and the EU Court of Justice.[Abstract appeared in the Journal]
