This paper questions the relationship between disability and the criminal sciences, in order to understand whether the legal system has provided suitable instruments for the protection of individuals with psycho-physical infirmity. The analysis returns a tendentially complete legislation in the field of criminal law, although not free from certain criticalities. In contrast, however, is the case in criminal proceeding law, where the protection of disability has long been relegated to the background. It was not until 2023, in fact, that the Constitutional Court recognised adequate procedural protection even for physical disabilities by extending the provisions provided for mental disabilities to the latter.[Abstract appeared in the Journal]
