Although initially conceived as a mere reform treaty of the pre-existing treaties, explicitly stripping away all symbolically constitutional elements, the Treaty of Lisbon nonetheless retained many of the innovations that had characterized the failed Constitutional Treaty. This paper aims to assess whether these novelties, with particular reference to the sources of secondary law and their interactions with domestic legal systems (especially through the principle of direct effect), have effectively continued the process of constitutionalising the Union that began in the early stages of European integration, despite the Treaty of Lisbon abandoning any formal constitutional aspirations.[Abstract appeared in the Journal]
