Since 2021 in Italy a reform of the disability protection system is underway, aimed at guaranteeing social inclusion and the restoration of life autonomy. The Authors illustrate the procedural issues of the enabling laws regarding disability (Law 227/2021) and not-self-sufficiency (Law 33/23) and the implementing decrees issued (Legislative Decree 62/24 and Legislative Decree 29/24). The model proposed in 2006 by the United Nations Convention on the Rights of Persons with Disabilities inspired the reform promoted by the Law n. 227 of 2021 ("Delegation to the Government regarding disability"), aimed at promoting the integration of people with disabilities and allowing them to fully exercise their civil and social rights. Law 227/2021 aims to implement a new bio-psycho-social approach to disability, in place of the old welfare scheme based on impairment. Disability will thus be understood as the result of the interaction between the person and environmental and behavioral barriers. Legislative Decree no. 62 of 5th March 2024 gave a new definition of disability and reformulated the art. n. 3 of Law 104/92, eliminating the old terminology of "handicap". The assessment procedures have been simplified in a single collegial visit, which will include a basic assessment, aimed at recognizing the condition of disability and need for support (by using the international classifiers of diseases and functioning and questionnaires capable of reveal the level of self-perception of disability as a form of direct participation of the person), followed by a possible multidimensional evaluation, aimed at the development and implementation of the personalized life project, taking into account the barriers and facilitators present in the different contexts. The reference for the evaluation of non-self-sufficient elderly people is the Delegating Law of 23 March 2023, n. 33 containing "Delegations to the Government regarding policies in favor of elderly people". This regulatory intervention provides for the application of the multidimensional evaluation approach also in the evaluation of non-self-sufficient elderly people and the strengthening of local social services for the prevention of institutionalization and the maintenance of life autonomy. The Legislative Decree n. 29 of 15th March 2024 proposes the reorganization, simplification, and coordination of social-health care activities for non-self-sufficient elderly people and the unified multidimensional evaluation. Future decrees are needed to provide the tools and methods for the assessment. The provisions included in the decrees appear to fill the gaps in a fragmented protection system. However, numerous questions remain regarding the concrete implementation of the proposed new model.[Abstract appeared in the Journal]
