Damage from loss of "chance", understood as the deprivation of the possibility of achieving a useful (more) favorable result, is increasingly the subject of a claim for damages in the civil medical-legal field. This, often presented by the creditor only in the alternative to the damage to health, however, has peculiarities such as to make it a category independent of biological damage "stricto sensu". What, possibly, must be compensated, in fact, is not the failure to achieve the result, but the sacrifice of the possibility of achieving the same. This expectation is itself the object of protection, as an independent current right other than health. In other words, the loss of chances must not be considered as a sublevel of ordinary causality (weak or "soft" causality), or as a "diminutio" of the rule on the ascertainment of the causal link, but as an independent damage to be quantified in equitable way. It is, therefore, a medico-legal field in which the civil law doctrine declines features more often belonging to the labor law one. In analyzing the problem with specific reference to the oncological field, the Authors wanted to propose a parallelism between labor law/administrative law and health law, through the study of the respective Italian sentences; so much for the purpose, not of setting doctrinal constraints, but of providing a point of reflection on a topic which, de facto, constitutes a case in point that has only recently been explored in the specific field and, therefore, characterized by inconsistent interpretations.[Abstract appeared in the Journal]
