This essay proposes to provide a very brief introduction to Italian and English marine insurance, with particular reference to hull and yacht policies and their main features, and then to analyze in details the issue of the possibility for an insurance Company to indemnify a damage due to particular average under Italian and English law and the clauses most widely used in the two aforesaid insurance markets, in order to demonstrate the remarkable differences that characterize the regulation of the subject in the field of "hulls" and with reference to yachts in the two aforementioned insurance systems, as well as to give an account of the changes in Italian case law with reference to the interpretation of the clauses on the possibility to indemnify non-repaired damages.[Abstract appeared in the Journal]
