In common-law systems, the divorce court proceeds to a global reorganisation of property relationships, distributing assets even irrespective of their (formal or substantial) ownership, on the basis of criteria of reasonableness and equity, taking into account the contribution made by each person to the marital ménage. In the "Jones", "Levitan" and "De Prins" cases, the principle of equitable distribution was not considered capable of being limited by the presence of a spendthrift trust, placed to protect the beneficiary spouse. Consequently, comparing marriage to an association, the right of each spouse (or associate) to a share of the family (or social) estate is recognised in the event of the dissolution of both.[Abstract appeared in the Journal]
