The decision by the United Kingdom Supreme Court in Potanina v Potanin (2024 UKSC 3) is one which seems capable of raising a number of questions for at least two reasons. In fact the majority of the court has reversed the judgment of the Court of Appeal which appeared to be in line with a number of precedents stating that a preliminary order granting, following a without notice hearing, a foreign divorced party abroad leave to seek in England and Wales financial relief under section 13 of the Matrimonial and Family Proceedings Act 1984 may only be set aside if there are compelling reasons and the other party can rely on a knock out blow. It has to be noted that the majority opinion is that such conditions are not necessary as they may result in the weakening of the respondent’s right to have his reasons heard before the leave is granted. On the other hand the Supreme Court doubts the actual existence of binding precedents to that effect. If, on the one hand, the principle enunciated by the Supreme Court is of overarching importance, it cannot be overlooked, on the other hand, that the distinction drawn, with regard to the precedent of the same Court in Agbaje v Agbaje (2010 UKSC 13), between ratio decidendi and obiter dictum may lead to some unconvincing results and may sound too formalistic.[Abstract appeared in the Journal]
