Non-competition agreements in labor law have long been a debated topic both in doctrine and in jurisprudence. And this, in particular, due to the fact that art. 2125 c.c. in this regard, it establishes that the agreement is void if it does not provide for consideration and if it is not contained within certain limits of object, time and place, leaving to the interpreters the exact identification of the right consideration and the limits in question, as well as the establishment of the application perimeter of the rule which, as can be seen from the heading of the same article, would seem to have to operate only where there is a risk of effective competition. Another important aspect not clarified by the legislator concerns the liability of a third party who knowingly favors the violation of a non-competition agreement between other parties, for example by contracting the worker linked to the agreement. The present reflection, which addresses the issues in question, arises from the event that this summer saw the Italian Football Federation posing the problem of evaluating the non-competition agreement that bound the person who later became the new coach of the national team greater than the club for which he was a member until last July.[Abstract appeared in the Journal]
