The judges of the Fifth Chamber of the Italian Supreme Court of Cassation stated that the victim bringing a civil action in the criminal trial, who has had the opportunity to defend her/his arguments in the probation proceedings through her/his defence counsel, in case she/he has not filed a motion to be heard by the judge presiding the probation hearing, does not have the right to challenge (before the Supreme Court) the order of probation that the trial judge issued without her/his previous deposition hereunto, even if she/he was present at the hearing. In this article, the A. first critically analyses the reasons underlying the principle of law stated by the Supreme Court; then, he furthers the analysis to an issue that has not been addressed by the Court, i.e., what is the typology of procedural deeds’ flaw originating from the violation of the victim’s right to intervene in the probation proceedings.[Abstract appeared in the Journal]
