In a background characterized by the prominent reform introduced by the "Code of the business crisis and insolvency" ("CCII"), which dictated new general rules also regarding the framework for predeductible claims, the A. is going to address two rulings of the Supreme Court, in which the Court resolves both times issues regarding the acknowledgement of the super-priority status, during an insolvency proceeding, for credits of professional services accrued during a prior composition with all creditors. After having analyzed the jurisprudential debate prior to the joint ruling of the Supreme Court n. 42093 of the 31th of December 2021, the A. is going to explain the reasonings behind the two rulings with particular focus on the joint decision of 2021 and on the innovative power of the CCII, while also providing insights based on the Civil Code and on the Code of Conduct for Lawyers, with the conclusion of a rising adjustment of case law on this particular subject.[Abstract appeared in the Journal]
