With the pronuncement in the heading, the G.I.P. of the Tribunal of Siena rejected the request for dismissal submitted by the P.M., wich was based on the observation that "considering the physiological timelines of the proceedings, a reasonable expectation of prescription materializes". This contribution, after analyzing the novelties introduced by the Cartabia Reform in the context of dismissal procedure, focuses on the impact of the statute of limitations on the judgment concerning the reasonable expectation of conviction. On this point, in doctrine, two different interpretative strands have emerged: on the one hand, some argue that the P.M. should consider all elements that are antithetical to the legislator’s objective, which is represented by the reasonable expectation of conviction; on the other hand, others, based on purely literal interpretation of the norm, admit inaction only in cases where the investigative activity has yielded a contradictory and insufficient picture regarding the suspect’s guilty, regardless of additional factors.[Abstract appeared in the Journal]
