The present essay on the reform of labour law deals with the hottest and most debated disputes revolving around such a reform. The issues are tackled in the following order. First of all, the article will deal with article 1, paragraph 9, letter (d), according to which an employment relationship and a contract for supply of staff may be concluded for a period not exceeding 12 months without any indication of technical, productive, organizational or substitutional reasons, as provided for by article 1 of the Law Decree No. 368/2001. Such a provision conflicts with letter a) co. 1 of the aforesaid Decree, in the light of which the permanent employment contract is the common form of employment relationship. It also clashes with the tradition that links the stipulation of a fixed-term agreement to the particular connotation of the employment relationship. The analysis will then focus on article 42, paragraph 1, which lays down different penalties according to the ground of illegality of the term clause, in contrast with the unity that should characterize the sanction for illegal dismissal - i.e. reinstatement of employment and compensation for damages, as provided for by article 18 of the Employees' Statute, or payment of a reasonable indemnity - while the several penalties laid down in Law no. 92/2012 raise criticisms and objections as to the validity and consistency of the new rules. Finally, the essay will examine paragraphs 48-68 of article 1, on the speeding-up of judicial proceeding concerning illegal dismissal, which creates huge difficulties for judges.[Abstract appeared in the Journal]
