The note comments on the decision of the Lazio Tar of 6 November 2023 n. 16396 which confirmed the provision of the competition authority which, on the basis of art. 62 of the legislative decree. 1/2012, had sanctioned three serious incorrect behaviors carried out by the Italian Sementi company in the management of the intellectual property relating to seed wheat "Cappelli" during the marketing phase. The criticism advanced in the comment concerns the original choice of the Agcm to limit itself to sanctioning the simple abuse of economic dependence which occurred in contractual relations, and not the undoubted disturbance on the entire market that such conduct had generated and which would have deserved more onerous penalty.[Abstract appeared in the Journal]
