LA NOMINA PRESIDENZIALE DEI FUNZIONARI STATALI

Art. 87, par. 7, of the Constitution attributes to the President of the Republic the power to appoint, in cases indicated by the law, public officials of the State. The analysis starts from a brief consideration of the role of the President of the Republic and then it focuses on the gestation of the constitutional provision, its meaning and implementation. In comparison with other provisions, the article received less attention despite the fact that it entails a series of interpretative problems concerning the text, the subsequent legislative framework and the practices followed by the various Presidents. The open questions refer, among others, to the nature of the presidential power, its object, the consequences of its exercise, the constitutional limits to the legislative discipline of the institute. By developing the indicated topics, the work will verify whether the provision has only a derivative and contextualized character, or it participates to the definition of the figure of the President of the Republic, thus contributing to the reflection on the "condition" of the Constitution between implementation and failure to execute, actuality and ineffectiveness.[Abstract appeared in the Journal]
